Terms and Conditions of Rental
This page provides our standard terms and conditions of rental for guests.
Windsor Wonderland offer the short term rental/letting of the Property named on the Invoice (a copy is supplied on booking of your vacation property), to the person of 21 years or over named as the lead guest.
Confirmed Booking
On receipt of the required payment from the yourself, Windsor Wonderland will issue a Invoice by emai to the lead guest. Only on release of the Invoice from Windsor Wonderland is the booking determined as confirmed.
Acceptance
You agree that payment of the rental deposit sum to Windsor Wonderland will signify your full acceptance of these Terms and Conditions of rental.
Payments
You agree and acknowledge that Windsor Wonderland will not release the check in detials until payment is received in full. If you fail to pay the balance in full will result in removal or refusal to supply the check in details. Such removal and or refusal will not alter the terms and penalties associated with cancellation.
You agree to pay the total rental fee as shown on the invoice within the due dates as set out on the booking confirmation. Final and full payment is due 8 weeks prior to arrival. In the event of late payment, or failure to pay, Windsor Wonderland reserves the rights to levy the cancellation penalty percentage charges against any money that you have paid in advance and/or cancel your booking. Where the money paid in advance is insufficient to cover the calculated percentage.
Check In
Check in to the Property is after 4:00 pm on the date of arrival as shown on the Invoice. Check in will take place at our 24/7 welcome centre, directions will be sent with your final invoice. We work on a keyless system, which means you will be given entry codes when you check in. This will mean you will not have to return any keys on departure.
Early check in may be available, subject to availability, please contact us for availability.
Check Out
Check out is on the date of departure as shown on the invoice, at 10:00 am. In the event that it is found that you have not departed the property on the date of departure, at the due time, then the Guest will pay a penalty charge of one days rental.
A late check may be available, please contact us for availability.
Basis of Rental
Properties offered for short-term rental through Windsor Wonderland are provided on a self-catering basis. Windsor Wonderland provides complimentary starter soap, toilet paper, and trash bags. Once these items are used, it is the guests responsibility to replenish them.
The Guest agrees that Windsor Wonderland can charge additional fees to cover:
- Early arrival or late departure charges
- Loss or breakage of inventory items
- Damage to the Property or its equipment
- Unauthorised Pets
Where loss or damage to the property, the inventory, or equipment exceeds $500, our management company will bill you for the shortfall, and you agree to pay within 14 days. In the event that you fail to pay any such shortfall, we reserve the right to exercise any legal remedies to pursue the amount owed from you. Where our management company finds damage or loss to the property following your departure that, in their view, constitutes malicious or wanton damage, they reserves the right to notify law enforcement authorities and prosecute, in addition to billing you for the full amount of repair or replacement, and you agree to pay within 14 days.
Security deposit
A security deposit of $500 is required for all bookings. On occasion, we may request a higher security deposit, but this is rare. The security deposit needs to be paid no later 7 days before check in and can be paid with the final balance. The easiest way to pay this is via paypal, but can be paid by other methods if preferred.
The security deposit will be refunded back after checkout, once it has been confirmed that there has been no damage.
Telephone calls
Free phone calls to land lines in most major countries are complimentary, although we are not are not held liable if the calls to some countries are not included in the Navis package. If you are concerned about this, please contact us and we can check if the country you want to call is included.
Pets
Pets are not permitted in the property. Guests with pets are advised to place their pet at another facility. Windsor Wonderland can not be held liable for any loss or injury to a pet while staying at the property, or for any action taken against the pet or pet owner by third parties. In the event that you bring a pet to the property,we may elect to evict you from the Property with loss of all rental money paid and/or levy a charge of at least $100 per bedroom per week to the credit card of the Guest, to pay for additional sanitation and cleaning on the departure of you and your pet.
Cancellation
You may cancel your booking at any time up to or during the rental period. In the event that you exercise your right to cancel, Windsor Wonderland will levy the following cancellation penalty percentage rates of the total rental fee (amount shown on the booking confirmation):
- From initial date of booking up to 8 weeks prior to the arrival date 20%
- Less than 8 weeks prior to the arrival date 100%
Windsor Wonderland regrets that it is unable to waive any of the cancellation charges above, whatever the circumstances. We recommend that all guests take out adequate cancellation or vacation insurance either through their insurance broker or travel agent.
Amendments to bookings
Where you choose to amend your booking 8 weeks or more prior to arrival, resulting in a change in the property size or a change of dates of stay, a $50 booking administration Fee will be levied. In the event of an amendment, you will need to contact us immediately, at which point a new quote will be issued for your amended dates, assuming that we have availability, and once agreed your booking will be amended.
Limitation of Liability
Windsor Wonderland makes all reasonable efforts to provide advice and safety information. This information can be found in the Home-Pack at the property. It is your responsibility to ensure that you have read and understood the contents and advice given following arrival at the property.
In addition, Windsor Wonderland states the following:
- We do not accept liability for equipment failure and or services in the property. In the event of failure of equipment,you must notify the management company within one working day so they attempt to rectify the failure.
- We do not accept liability for lost or stolen personal property of you, or anyone in your party, from the property during the rental period. We provide information and advice on security in the home pack In the event that your property is lost or stolen, you should advise the appropriate authority first, and then our management company of the lost or stolen items.
- Our management company or its representatives may enter the property at any time, without notice, for the purposes of protection and/or maintenance of the property. Wherever possible, our management company will provide notice to you prior to such entrance.
- We accept no liability for personal loss or injury to you or any member of your party during the rental period. You must ensure that they have adequate insurance cover. We provide information and advice in the home pack to you in an advisory capacity only, with no guarantee or promise implied.
- You must ensure that children are supervised at all times. It is our policy that all Children under the age of 18 years are not left in rental accommodation un-supervised during the rental period.
- We do not accept any liability for the acts or omissions of any agent. These include but are not limited to, airlines, car-hire companies, travel agents, ticket agents, or utility providers.
- We do not accept liability for failure of pool heat to provide adequate heating where pool heat is provided via an electrical heat pump, and where the outside air temperature drops below 55 degrees Fahrenheit. Electric heating pumps do not operate effectively below this temperature, and failure of such devices to heat the pool is outside of our control, and is regarded as an act of nature (see below).
- We do not accept liability for acts of violence, nature, fire, flood, war, civil disobedience, riot, or other force majure that may have a deleterious effect on you or any member of your party.
- Failure to comply with any of the terms herein will, at our sole discretion, result in the your eviction from the Property, without recompense
